Rules and regulations

Madison Crossing Fitness Center is open 7 days a week between 5AM and 10PM for all Fitness Center Members.  

Services:

 Madison Crossing Fitness Center agrees to provide you with the use of all equipment and amenities which are available to you under the terms of your membership. We reserve the right to add or remove services or amenities as reasonably warranted.

 

General Fitness Rules:

·    Entry to the Fitness Center must be made by use of your key card or QR Code via your phone. Entry via any other method is prohibited.

·    Misuse of membership cards/QR Codes in any form will result in immediate cancellation of membership with no refund. Memberships may not be lent to another person, may not be used to let non-members enter or sold to non-members. Trespassing action will be enforced.

·    We reserve the right to revoke or deny the membership for any member whose access to or use of Fitness facilities, in our judgment, creates a danger or health or safety hazard to you or other members.

·    For your safety, security cameras are on at all times.

·    We strive to uphold a safe and clean environment. As such, we expect proper, respectful conduct on the premises at all times.

·    We do not permit disrespectful conduct towards members, guests, employees, or vendors, including but not limited to vulgar, profane, indecent, offensive, violent, hostile, aggressive, threatening, harassing, stalking, fraudulent, or other inappropriate conduct or language.

·    Children under 12 are not permitted in the Fitness Center. Children between 12 and 18 years old may enter Fitness Center only with parental/adult supervision.

·    Do not bring in anything valuable. You agree that we are not liable for loss, theft, or damage to personal property of members. Lost and found items will be discarded if not claimed within 2 weeks from the day the item was found.

·    Proper workout attire (shorts, t-shirts, sweatpants, sweatshirts) should be worn. No inappropriate or vulgar words or graphics may be worn. Jeans or pants with buttons, hardware(zippers/rivets) are not allowed to prevent any damage to equipment or to you. Shirts must be worn at all times.

·    No food allowed. Drink containers must have with lids on them. No alcohol or illegal substances are allowed on the premised. If a person is perceived as intoxicated or under the influence they will be asked to leave.

 

Fitness Center Equipment

·    All equipment must be used in accordance with the posted instructions.

·    If you notice damage or any broken equipment, or any problems at all, please report immediately to madisoncrossing@wyellowstone.com to keep everyone safe.

·    All equipment is available on a “first-come, first-serve” basis. You may use the equipment for 30 min or less at a time during busy times.

·    Please wipe down the machines after your workouts using the towels and cleaner provided at the facility.

·    Return and Rack all weights (plates, dumbbells) after use. Violators will be asked to leave the facility.

·    Do not drop the weights or lean them up against anything and use extreme caution in mirrored areas.

 

Safety/Emergency

·    Madison Crossing Fitness Center is un-staffed. In case of emergency, call 406-646-7621 or 911.

·    In case of fire or alarm, always use caution and safely leave the building.

·    Any activity or exercise resulting in pain, faintness, dizziness, or shortness of breath should be stopped immediately.

·    By signing the waiver on your device, you agree that we are not liable for any injury or damages resulting from your use of our services and facilities. We urge you to see your physician before using our facilities.

Waiver:

The following is a waiver. Please read it carefully before signing and/or seek independent legal advice.  

I hereby stipulate and agree: That I realize the risks of cardiovascular exercise, weightlifting, weight training and body building and I am fully aware of the possibility of mechanical and/or other malfunctions of cardiovascular equipment, weight machines, and apparatus, ('equipment') due to the negligence of Madison Crossing Fitness, as well as, the possibility of injury to my person as a result of the use of such equipment.  I, therefore, fully understand and I am mindful of the serious consequences which might result due to my involvement in cardio vascular exercise, weight lifting, training and body building while at MCF premises, and based on that understanding, as set forth in this paragraph, I voluntarily assume any and all risk of loss, damage or injury of any kind, whatsoever, from my use of any and all equipment and facilities of MCF, and further and with full knowledge of the consequences (i.e. that I am waiving my right to sue) expressly waive any and all liability on the part of MCF and it's equipment and facilities.

That I am physically sound and have medical approval to proceed with a normal routine of exercise.  That all exercises shall be undertaken by me at my own risk.  That I am in good health and have no physical conditions that would be aggravated by my involvement in cardiovascular exercise, weightlifting, training and body building, nor do I have any physical limitations that would preclude said involvement.  I also release MCF and its contractors (personal trainers) from liability from their negligence, defective equipment, injuries from dangerous condition of property, etc.

That I am forewarned that MCF will NOT, in any event, provide medical and/or hospitalization insurance for my benefit, and in the event of any injury to my person occurring either as a result of my being on any portion of the premises of MCF.  I will save harmless and keep indemnified MCF and their respective trustees, beneficiaries, staff, and officers from and against any and all actions, claims, costs, expense or demands, in respect of such injury or injuries, including death, howsoever caused, arising out of or in connection with my use of the MCF facilities or my being on any portion of said premises, including any part of the building, sidewalks, stairways, or parking areas.  Notwithstanding that the same may have been contributed to or occasioned by the negligence of MCF and their respective staff, representatives, officers, trustees, or beneficiaries. That I am hereby informed of my option to sign a new release on each date that I renew my membership with MCF. However, I elect to forego that option and I therefore acknowledge and specifically intend that this release and waiver of rights shall be effective not only on the date hereof, but also on all occasions subsequent hereto when I shall use the MCF facilities.
